Terms of Service

QwikJob is an online marketplace that connects employers who need work done with freelancers who do it. QwikJob is a brand and trading style of Evoastra Ventures (OPC) Private Limited, a company incorporated in India with its registered office at Flat No. 101, Shree Samarth Building, Swami Samarth Nagar, Alibag, Raigad, Maharashtra 402201, India.

These Terms of Service govern your access to and use of qwikjob.com, our applications and related services (together, the “Platform”). By creating an account, browsing listings, posting a project or making a payment, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Platform.

In these terms, “we”, “us” and “QwikJob” mean Evoastra Ventures (OPC) Private Limited. “You” means the person or organisation using the Platform. An “Employer” buys services; a “Freelancer” sells them; “User” means either.

To use QwikJob you must:

• be at least 18 years old and legally able to enter into a binding contract;
• provide accurate registration details and keep them current;
• have authority to bind any business you register on behalf of; and
• not be barred from receiving these services under any law that applies to you, including sanctions and export-control laws.

We may refuse, suspend or close an account where we reasonably believe these conditions are not met.

You are responsible for everything done under your account, including work commissioned, payments authorised and messages sent.

• Keep your password confidential and do not share your login.
• Tell us promptly at support@qwikjob.com if you suspect unauthorised access.
• One person or organisation, one account. Duplicate accounts made to evade a suspension, inflate ratings or bypass limits may be closed.
• Accounts are personal to you. You may not sell, rent or transfer an account or the reputation attached to it.

QwikJob provides the marketplace, the payment protection and the tools around a working relationship. We are not a party to the contract between an Employer and a Freelancer.

Freelancers are independent contractors. Nothing here creates an employment relationship, partnership, agency or joint venture between QwikJob and any User.

We do not supervise, direct or control the work. We do not guarantee that a project will be awarded, that any deliverable will meet expectations, or that a User is who they claim to be beyond the checks described on our Trust & Safety page.

Each engagement is a direct contract between the Employer and the Freelancer, on the scope, timeline and deliverables they agree.

QwikJob charges 0% commission on the value of work. A Freelancer keeps the full amount an Employer pays for their services.

We earn from optional paid features instead:

• subscription plans that raise limits and unlock features;
• promotional placements, such as featured listings; and
• AI credit top-ups, where AI features are used beyond an included allowance.

Prices are shown before you buy and are in Indian Rupees (INR) unless stated otherwise. Applicable taxes and any payment gateway charges are shown at checkout.

Paid plans renew automatically for the stated period unless cancelled before the renewal date. You can cancel any time from your dashboard. Cancelling stops the next renewal; it does not shorten the period already paid for, and part-periods are not refunded unless the law requires it.

Money for a project or milestone is collected up front and held in escrow with our regulated payment partner before work begins. It is not paid to the Freelancer at that point.

Escrowed funds are released to the Freelancer when:

• the Employer approves the delivered work or milestone;
• the Employer neither approves nor disputes it within the review window shown on the order; or
• a dispute is decided in the Freelancer's favour.

Escrowed funds are returned to the Employer where the engagement is cancelled before work begins, or where a dispute is decided in the Employer's favour.

We use regulated payment partners to collect, hold and disburse money. We do not store your full card or bank account details on our own systems.

Before a Freelancer can receive money they must set up a payout account with our payment partner and complete that partner's identity checks (KYC). This is a requirement of the payment partner and of Indian law, not a QwikJob preference.

• Bank details must be accurate and in the Freelancer's own name. Banks reject transfers where the name does not match.
• We release funds to the payment partner, which settles to the bank account on its own schedule. That timing is not within our control.
• A payout may be delayed or withheld where identity checks are incomplete, where a dispute or chargeback is open, or where we are required to withhold by law.

You are responsible for the payout details you enter. We are not liable for money sent to an account you gave us incorrectly.

An Employer and Freelancer may agree to cancel at any time. Where work has not begun, escrowed funds are returned to the Employer. Where work has partly been delivered, the parties should agree a fair split; failing that, either may open a dispute.

Subscription fees, promotional placements and AI credits are not generally refundable once the benefit has been delivered, except where the law requires it or where we have charged you in error. If you think you were charged in error, write to billing@qwikjob.com within 30 days.

Please use our dispute process rather than raising a chargeback with your card issuer. Where a chargeback is raised, we may suspend the account while it is investigated, and we will provide the issuer with the transaction records it requests.

You are responsible for your own taxes. QwikJob does not give tax advice.

• Freelancers are responsible for declaring their income and for any GST, income tax or other tax that applies to them.
• Employers are responsible for any tax on their purchase and for any withholding their own law requires.
• Where Indian law requires us to collect tax at source, deduct tax at source, or report transactions to the tax authorities, we will do so, and the relevant statements will be available in your dashboard.
• Where a Freelancer in India is paid by an Employer outside India, that may be an export of services with its own documentation and GST treatment. Keep your records; certificates issued by our payment partner are your evidence.

If an Employer and a Freelancer disagree about delivered work, either may open a dispute from the order, within the dispute window shown there.

How it works:

• Both sides are asked for their account and any evidence: the brief, messages, files and delivery history on the Platform.
• Escrowed funds stay held while the dispute is open. Neither side can withdraw them.
• Our team reviews the record and decides an outcome: release in full, return in full, or a split.
• That decision is final between the parties for the purpose of releasing the escrowed money.

We decide only where the escrowed money goes. We are not a court, we do not award damages, and our decision does not determine any other legal rights either party may have. We cannot reliably verify what happened off the Platform, which is why we ask you to keep project communication on QwikJob.

You agree not to:

• post false, misleading or plagiarised listings, profiles, portfolios or reviews;
• impersonate anyone, or misrepresent your identity, skills or qualifications;
• take or offer payment outside the Platform for work introduced through it;
• post unlawful, infringing, hateful, harassing, sexually explicit or violent content;
• request or deliver unlawful work, including academic dishonesty, fraud, hacking, or circumventing security or access controls;
• scrape, crawl or bulk-extract data from the Platform, or use automation to create accounts, messages, listings or reviews;
• probe, scan or attempt to breach the security of the Platform, or disrupt it; or
• use the Platform to launder money, evade sanctions, or finance unlawful activity.

Moving an engagement off-Platform is not a technicality we overlook: it removes the escrow that protects both sides. If it then goes wrong, we cannot help, because we are holding nothing.

You keep ownership of what you upload: profiles, portfolios, listings, briefs, files and messages.

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for display and transmit that content, solely so we can operate and promote the Platform. The licence ends when you delete the content, except for copies we must keep for legal, accounting or dispute purposes and for backups overwritten in the ordinary course.

As between an Employer and a Freelancer, and unless they agree otherwise in writing: ownership of the deliverables passes to the Employer once the work is delivered and paid for in full. Until payment is complete, the Freelancer retains ownership.

Freelancers keep ownership of their pre-existing tools, libraries, templates and know-how, and may show delivered work in a portfolio unless the Employer has agreed a confidentiality or non-publication term.

The QwikJob name, logo, interface and software are ours. Nothing here licenses you to use them beyond ordinary use of the Platform.

Some features use artificial intelligence to draft, summarise, translate, match or suggest.

• AI output can be wrong, incomplete or biased. Check it before relying on it, and never treat it as legal, financial, medical or tax advice.
• You are responsible for anything you publish or send that AI helped produce, exactly as if you had written it yourself.
• Do not enter confidential information, other people's personal data, credentials or payment details into an AI feature.
• AI features send your prompt to third-party model providers. Our Privacy Policy names them and says what is sent.
• Included allowances and purchased AI credits are for use on the Platform. They are not money, have no cash value, and are not refundable or transferable.

AI features may change, be limited or be withdrawn, and we may apply fair-use limits to keep them available to everyone.

A review must reflect a genuine engagement and your honest experience.

• Do not buy, sell, trade or solicit reviews, or offer anything of value for one.
• Do not threaten a negative review to obtain something you are not entitled to.
• We do not edit reviews for tone. We may remove one that breaches these terms, exposes personal data, or is the product of manipulation.

Ratings, levels and badges are calculated by us and may be adjusted. They are indicators, not guarantees.

We may remove content, limit features, suspend or close an account where we reasonably believe these terms have been breached, where the law requires it, or where it is necessary to protect Users or the Platform.

Where practical we will tell you why and give you a chance to respond, and you may appeal to support@qwikjob.com. Where the issue is serious, such as fraud or a safety or legal requirement, we may act first and explain afterwards.

You may close your account at any time from your settings. Closing it does not cancel obligations already incurred: open engagements, money owed and escrowed funds are settled or refunded first, and we keep records we are legally required to keep. Our Privacy Policy explains what happens to your data.

We work to keep QwikJob available but do not promise uninterrupted or error-free service. Maintenance, third-party failures and events outside our control can interrupt it.

We may add, change or withdraw features. Where a change materially reduces a paid benefit you are currently paying for, we will tell you in advance and you may cancel.

The Platform is provided on an “as is” and “as available” basis. To the extent the law permits, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant the quality, safety, legality or accuracy of any listing, profile, deliverable or User statement. Verification badges and ratings are signals, not guarantees, and you remain responsible for your own checks before engaging anyone.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.

To the maximum extent the law permits, and except where liability cannot lawfully be limited:

• we are not liable for indirect, incidental, special, punitive or consequential loss, or for loss of profit, revenue, goodwill, data or anticipated savings, however caused; and
• our total liability for all claims arising out of or relating to the Platform in any twelve-month period is limited to the greater of the fees you paid us in that period or INR 10,000.

We are not liable for the acts or omissions of any User, including work that is late, defective, infringing or never delivered. Your remedy in that case is against that User, with our dispute process available to decide the escrowed money.

You agree to indemnify and hold QwikJob harmless against claims, losses and reasonable costs arising from your breach of these terms, your content, your use of the Platform, your engagements with other Users, or your breach of any law or third-party right.

We will notify you of any such claim, let you take part in the defence, and will not settle it without your consent where that consent is reasonably given.

These terms are governed by the laws of India.

The courts at Raigad, Maharashtra have exclusive jurisdiction over any dispute arising out of or relating to these terms or the Platform, and you consent to that jurisdiction.

Before starting proceedings, please contact us so we can try to resolve the matter directly. Most issues are settled faster that way.

Under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, complaints about content or about your use of the Platform may be sent to our Grievance Officer.

We will acknowledge your complaint within 24 hours and aim to resolve it within 15 days of receipt. Please include your account email, what happened, and any links or screenshots.

We may update these terms. The “last updated” date at the top shows when we last did.

For material changes we will give notice on the Platform or by email before they take effect. Continuing to use QwikJob after that date means you accept the updated terms. If you do not accept them, stop using the Platform and close your account.

Changes do not apply retrospectively to engagements already under way.

• If any clause is held unenforceable, the rest continues in force.
• Our not enforcing a term is not a waiver of it.
• You may not assign your rights under these terms. We may assign ours to a successor of our business, on notice to you.
• These terms, together with the Privacy Policy and any plan terms you accept, are the entire agreement between us about the Platform.
• Headings are for convenience and do not affect interpretation.
